DEP says it does not provide advice, guidance or assistance with pond design or construction methods, and that anyone interested in constructing a pond should first call DEP to determine what authorizations, regulatory requirements and potential mitigation may be involved. [1]

DEP's pond page routes questions by type. For the pond activities in its FAQ, which may or may not need Chapter 105 authorization, DEP says an erosion and sedimentation (E&S) control plan and E&S best management practices are required under Chapter 102, and it sends E&S plan and permitting questions to the county conservation district or the applicable DEP regional office. The page adds that any repair or modification of a jurisdictional dam should be presented to DEP's Division of Dam Safety, and that any activity that changes a pond's cross-section and does not qualify as maintenance requires a Water Obstruction and Encroachment Permit from the appropriate DEP regional office. To find your conservation district and DEP regional office, DEP's individual NPDES permit application instructions (Rev. 7/2026) point to the Pennsylvania Association of Conservation Districts website (www.pacd.org, "Your District" > "Find Your Conservation District") for conservation district mailing addresses, and to www.dep.pa.gov ("Contact Us" > "Office Locations") for DEP regional office mailing addresses. DEP also says a pond builder may want advice from the Natural Resources Conservation Service, the Pennsylvania Fish and Boat Commission or the Penn State Cooperative Extension Office, but that these agencies and consultants are not the appropriate resource or authorized to provide regulatory interpretation. Statewide program offices: dam safety, chemical use and stormwater

DEP's Bureau of Waterways Engineering and Wetlands web page says the Bureau's Division of Dam Safety oversees the regulation of approximately 3,400 dams and reservoirs in Pennsylvania. The page lists the Bureau's mailing address as PO Box 8460, Harrisburg, PA 17105-8460, office phone 717-787-3411 and fax 717-772-0409; its onsite address is 400 Market Street, 2nd Floor, Rachel Carson State Office Building, Harrisburg, PA 17101. DEP's Environmental Assessment instructions (Rev. 3/2022) list a different number for the Division of Dam Safety, 717-787-8568, and give 717-787-3411 for the Division of Wetlands, Encroachments and Training. The Corps Baltimore District's Pennsylvania permits page also gives 717-787-8568 for the Bureau, as the office to write or call for an application. [8][16][17]

For a joint chemical-use (pesticide) permit, DEP's mailing address depends on the county where treatment will occur, and applicants may also submit through DEP's Public Upload with Payment tool. DEP says questions about its pesticide permitting can be sent to its Bureau of Clean Water at RA-EPNPDES_Permits@pa.gov or (717) 787-5017. [11]

DEP also lists a Fish and Boat Commission mailing address, the Division of Environmental Services, 595 E. Rolling Ridge Drive, Bellefonte, PA 16823 (814-359-5147), but says that address is only for proposed pesticide use in free-flowing waters or application of fish control chemicals. [11]

Federal: U.S. Army Corps of Engineers districts covering Pennsylvania

For Pennsylvania joint permit applications, DEP's instructions say the Baltimore District covers the Susquehanna River Basin, the Philadelphia District covers the Delaware River Basin, and the Pittsburgh District covers the Ohio River basin and the portions of the Lake Erie and Genesee River basins located in Pennsylvania. The Baltimore District takes permitting questions for central Pennsylvania and refers western Pennsylvania (Ohio River watershed) to the Pittsburgh District and eastern Pennsylvania (Delaware River watershed) to the Philadelphia District. The Pittsburgh District says regulatory boundaries are drawn by a combination of state, county and watershed, so applicants should confirm the servicing district on the USACE Regulatory Boundary Map, which gives the local office's name, address, phone number and website for an address or map point. The Pittsburgh District says its Pennsylvania permits are filed jointly with DEP: applications go to the state, which forwards them to the Corps if a Corps review is required; if not, federal authorization is issued with the state authorization. Under PASPGP-7, effective July 1, 2026 and expiring June 30, 2031, DEP forwards applications for Reporting Activities to the Corps. [7][23][25]

Floodplains: your municipality and PEMA

PEMA says that to find out whether a property is in a flood hazard area, consult the FEMA Flood Insurance Rate Map or contact the community's floodplain administrator; FEMA's Map Assistance Center (1-877-336-2627) can help interpret the maps. Development can take place in the Special Flood Hazard Area if it complies with local floodplain ordinances that meet NFIP criteria. [29]

PEMA says proper administration and enforcement of floodplain management is the municipality's responsibility. DEP says asking the local municipal government will show whether a floodway has been determined along a particular watercourse or body of water. [22][30]

DEP's joint permit instructions say that where no FEMA floodway has been determined along a watercourse, the floodway is considered to extend 50 feet landward from the top of each streambank. For bodies of water, which include natural and artificial lakes and ponds, DEP says that in most cases FEMA has not delineated a floodway and this 50-foot rule does not apply; a permit is required only if the structure or activity adjoins or encroaches into the body of water or into the floodway as defined by FEMA.
